§ 505.065. Bond Required.

  • A. 
    No person, firm or corporation shall perform or cause to be performed any work or construction on presently existing roadways or roadway easements, hereafter contracted for, except maintenance works, within the City of Warson Woods, unless said person, firm or corporation deposit with the Clerk of the City of Warson Woods, an indemnifying bond approved by the City Engineer, in an amount equal to twice the estimated cost of said works or construction; said bond shall indemnify the City of Warson Woods and its residents, jointly and severally, against any and all losses, damages, costs and expenses to any property, whatsoever, whether owned by the City of Warson Woods or any resident or residents, caused or occasioned by, directly or indirectly, the existence, operation or maintenance of said works or construction, whether caused by the faulty, unworkmanlike or negligent works or construction of said person, firm or corporation, or not.
    B. 
    Any person, firm or corporation desiring to make an excavation, dig up or ditch or otherwise interfere with any of the streets including the right-of-way of the City adjacent to such street within the limits of the City of Warson Woods for any purpose whatever shall apply to the Clerk of the City of Warson Woods for a permit, which permit shall only be issued by the City Engineer.
    C. 
    Any such person, firm or corporation who shall perform or cause to be performed any such work or construction without first having complied with the provisions of the foregoing Subsection (B), shall be subject to the penalty provision of § 540.010 of this Code.
